A Coruña, Jul 14 (EFE).- The Supreme Court rejected the precautionary suspension of the precautionary election of A Coruña as the headquarters of the Spanish Agency for the Supervision of Artificial Intelligence (Aesia).
The contentious-administrative chamber of the Supreme Court, in an order of July 10 released this Friday, has denied the precautionary suspension of the agreement of the Council of Ministers of December 5, 2022 that determined that A Coruña would be the physical headquarters of the Aesia.
Likewise, it has imposed the costs for this incident on the Granada City Council, which prompted this precautionary suspension.
In the order, the high court considers that there are no risks of an irreversible situation occurring and that the appearance of good law does not exist for the adoption of the precautionary measure raised by the Consistory, which has appealed the agreement also for substantive issues , in addition to the aforementioned precautionary suspension now denounced.
The Chamber applies the same criteria as in the denial order that resolved the request for precautionary measures regarding the designation of Seville as the headquarters of the Spanish Space Agency.
“The situation is the one described in the brief requesting precautionary measures and there are no elements or have not been brought to the process that indicate that irreversible steps are being taken,” he says.
As in the case of Seville, the key will be when resolving the merits of the matter, the moment to establish the origin or not of the determination of the headquarters of the Spanish Agency for the Supervision of Artificial Intelligence before its creation.
It will also be essential to judge the other extremes raised by the appellant City Council regarding the procedure followed, the criteria used and their conformity or disagreement with the constitutional and legal precepts adduced.
