Vox has not been able to formalize its candidacy for Congress for the province as part of its members resigned without this formation having time to present other candidates to complete it.
The Central Electoral Board endorses the resolution of the Provincial Board and indicates that it does not admit Vox’s resources because what is being challenged is the denial of the candidacy for Santa Cruz de Tenerife, as a consequence of the decisions adopted by the then provincial representative of the political formation, when the candidacy was left without a sufficient number of members for its proclamation.
It adds that as established by law, in the face of the denial of a candidacy, there is only room for appeal before the Contentious-Administrative Court, without it being possible to file an electoral administrative appeal before the Central Electoral Board.
It adds that, as the representative of Vox acknowledges in his brief, they have filed the aforementioned contentious-electoral appeal, which is why, since it is in said jurisdictional area, it is not possible to examine it in this instance.
This agreement is final in administrative proceedings and a contentious-administrative appeal may be filed against it before the Third Chamber of the Supreme Court within a period of two months from its notification. EFE
