Valladolid (EFE).- The Secretary General of the Conference of Ministers of Justice of Ibero-American Countries (COMJIB), the Colombian Enrique Gil Botero, has been convinced that the steps taken worldwide to promote the use of business mediation It is an alternative of “speed” and efficiency against the “congestion” of a sometimes “pachydermic” justice system.
In an interview with Agencia EFE, days before participating in Valladolid in the First World Summit on Business Mediation organized by the Spanish Chamber of Commerce, Gil Botero hoped that this event could become “a reference to bring the culture of trust, meeting and dialogue”, as an alternative method to conflict resolution, outside the Courts of Justice.
“It is the construction of a citizenship in the culture of peace and that undoubtedly has to do with justice and with the contribution of a series of values such as improving competitiveness”, explained the leader of this organization based in Madrid, Created in 1970 and comprising the Justice Departments of 22 Ibero-American countries.
Anglo-Saxon origin
Gil Botero has recognized that these advances in mediation and arbitration come from the Anglo-Saxon sphere, with greater emphasis in the last three decades, but has added that this “culture of dialogue” has “radiated” to all Ibero-American countries, helped by the quantifiable business effectiveness and efficiency traits that accompany them.
The leader of the COMJIB has resorted to Aristotle to defend that “the best judge is the parties”, convinced that “you only have to go to ordinary justice when dialogue, understanding and understanding have failed”.
“Sometimes our justice in all our countries is pachydermic, it is congested, it has a series of costs, not only in time, but in other values that really create friction against the interests of those who go to justice. On the other hand, in these techniques (of mediation) there is speed, there is efficiency”, Gil Botero has summarized.
Online commerce and security
In a world marked more and more by electronic commerce and international economic transactions, in which conflicts arise daily with the simple delivery of a package, the representative of the Ibero-American justice has opined that the development of “mechanisms is key” alternatives” so that the resolution of conflicts between companies and also with respect to clients are agile enough so as not to discourage these exchanges.
“Business mediation is providing a series of advantages… because first of all it gives confidence, gives legitimacy, gives cohesion and gives social peace and the fabric of society, let’s say it is strengthened through speed”, he has summarized on this issue .
Gil Botero has also alluded to the importance of the development of the so-called Medellín Treaty, which helps to facilitate procedures that until now were long, such as some for the extradition of prisoners between countries. As an example, he has spoken of the Colombian businessman Carlos Mattos’s transfer from Spain to Colombia, which was delayed for two years and which can now be done “in a minute”, he has highlighted.
Regarding this type of agreement, which promotes the fight against organized crime at an international level, Gil Botero has been convinced that, together with other technological tools such as IberRed, the countries involved manage to take a step forward to shorten the distance with respect to criminals. .
Crime in ‘jet’
Aware that up to now there is the feeling that the Justice “was on a mule or a donkey” in the face of a “crime that was on a jet”, these tools take a step and try to “recover” that situation, so that the Justice in Ibero-America “also go by jet”.
The Medellín Treaty and the different intergovernmental collaboration platforms are, in the words of the COMJIB leader, “a battering ram” against “very powerful” international crime.
Regarding his continuity at the head of the organization, he has hoped to receive the support of his colleagues, because the work of these years has been “a very valuable reputational asset” for the Confederation.
“We are going on a pure rise, so the idea is to continue to finish all the projects that we are executing at the moment”, after assuming this position in 2019, while if elected it would be his last possible term, since he is limited to two out of four years.EFE
