According to the magistrate in the judicial decision, which can be appealed, the person investigated, a Chinese national like the victim, began the attack with “such violence” that it practically nullified any possibility of defense.

The “brutality” of the first blow to the right side of the neck, together with a second attack on the neck, which severed it, caused the death of the woman with no possibility that anything could be done for her life.

In the appearance held in the Violence against Women Court of Pamplona, the Public Prosecutor requested the ratification of the provisional detention communicated and without bail. He argues that provisional detention should be maintained because the person investigated lacks work and family roots in Spain and has a conviction for a crime of gender violence. He adds arguments such as the seriousness of the facts, because the penalties he faces in this proceeding are very high, and because of the need to preserve the rest of the investigative proceedings that remain pending.
He explains that the first indications collected by the duty judge have been confirmed by the investigation carried out up to now. This has consisted of the autopsy of the deceased, the initial visual inspection of the scene and the statement of the victim’s children and relatives of the couple.
Deceased and defendant were a recent couple
The aforementioned witnesses have confirmed that the deceased and the defendant were a couple and that they had met on an undetermined date, approximately Easter.
In May, the person investigated, who did not reside in Pamplona, went to dinner with the victim and his children and relatives. She introduced them to them as a couple and a possible partner to open a business. This fact, according to witnesses (a friend, co-worker, sister-in-law and children), led to a radical change in the couple and led to the start of problems. Discussions between them over labor issues were common “since the person investigated did not accept that the victim, as a woman, told him how to run the business.”

On the morning of July 1, when the victim was cooking in said premises, she was attacked from behind. She received a first blow with a machete “so strong on the right side of the neck” that it caused an incised wound 4.5 centimeters in length, which caused an incomplete fracture of the calotte (upper part of the skull). With the same machete, she picks up her car, she subsequently sectioned his neck, including the trachea.
