Santa Cruz de Tenerife (EFE).- The Provincial Court of Santa Cruz de Tenerife has imposed a 44-year prison sentence on Gabriel Iván MD and the payment of compensation of 200,000 euros for considering him responsible for the death of his parents in March 2020 in San Miguel de Abona, in the south of Tenerife.
The compensation will be divided equally between each of his two brothers and it is also determined that he will not be able to access the third degree until he has completed half of his sentence.
The crime took place on the night of March 11, 2020 at the victim’s house, located in the Tenerife municipality of San Miguel de Abona.
At the time, the popular jury determined that the murder was carried out in a particularly violent and surprising manner and therefore applied the aggravating factors of treachery and kinship.
After hearing the verdict at the end of May, the Prosecutor’s Office raised its request for prison sentences from 20 to 22 years for the death of the father and the same for the mother and the payment of 300,000 euros to each of the other two children.
The private prosecution requested 25 years and 500,000 euros for each one and the defense limited it to 20 years and in terms of civil liability, he recalled that the convicted person is insolvent.
In total, the son stabbed each of the victims seven times and also tried to slit their throats as he usually sacrificed the animals that the family raised on their farm.
The attack was carried out first from the front when he stabbed and then from behind to slit their throats, although cruelty was ruled out because death was quick.
The extenuation of committing the crime under the influence of drugs for being a chronic cocaine user is not accepted and for this it is based on the report of the psychologist who appeared at the hearing, who declared that the defendant was aware of what he was doing and that could have been controlled.
The ruling states that the crime was committed when, as was customary, he asked his mother for money and when he refused, he attacked her while the father was in the bathroom and, upon hearing the screams, he came out half-naked and suffered the same fate.
Then the already convicted man took around 600 euros that his mother always carried in a fanny pack and that was the money she earned on the weekend at a market, stole all the mobiles and even the landline and took the father’s car .
He put the bloody clothes and the knife in a bag that he threw in a container that was finally taken to the Arico PIRS, so its contents could not be recovered, but the car keys could.
With what was stolen, he bought more drugs in Cabo Blanco, saw some friends to whom he confessed what had happened, and spent the night with a prostitute.
On the 13th, as her two brothers were surprised that their parents did not answer the phone, they went to the house in the afternoon and from the window they saw the woman’s foot in the middle of a pool of blood, almost coagulated.
The Local Police was the first to arrive and an agent entered through the window and found the mother, then a series of bloody traces led him to the father’s body and then the Civil Guard came.
The brothers from the first moment suspected the now condemned for his addictions and the habit of demanding money from the mother that had worsened in recent days. To this is added that the door had not been forced and the absence of disorder, so it was deduced that the author knew the house.
That same night the agents called him on his cell phone and after initial reluctance, they finally managed to meet him at a gas station.
After having a talk with him, he finally informally confessed to them the crime that he attributed to his addictions since his parents continually compared him to his brother. In his pocket there were only 10 euros of the 600 stolen.
After three years in provisional prison, on the first day of the trial he declared that he did not remember what had happened, that he had found out the week before by reading the local press but that he supposes he was the culprit because there was no one else in the house, although he did not know I remembered almost nothing.
At the beginning of the second day of the hearing, he asked to testify again, attributing the contradictions of the day before to the effects of the strong medication he took in prison before they took him to the Court. This time he answered “yes” when his lawyer asked him if he had stabbed his father and his mother.
The brothers recounted how the defendant had changed his character since he started taking drugs at the age of 20, also that he was convicted twice for mistreatment of his partners and that the father had warned them that he was going to kill them any day.
The prosecutor insisted on several occasions if the police had found traces of narcotics in the house and the answer was always negative, since the defendant had reported that before committing the crime he consumed “half a gram or a gram of crack.”
The medical experts explained how the crime was committed and the scientific possibilities that he was responsible.
During the trial it emerged that he had gone to live at his parents’ house because he was threatened and could not be in his house or that from prison he sent his brothers two letters confessing to the crime and asking for forgiveness, at the same time as a prisoner in his name conveyed the same message to them.
In total, the defendant maintained three versions, in the defense brief it was said that he was innocent, in his first statement he appealed that he did not remember anything and attributed what happened to drug use and finally on the second day he already openly recognized the crime. EFE
