In the expansion of its complaint, to which EFE has had access, this association asks to verify “the reiteration or accumulation in different electoral periods” of the inclusion of ETA convicts on the Bildu lists and that they have not reneged on terrorist purposes , which is considered a violation of the Party Law and therefore a reason for its illegalization.
Article 9.3 c of the Law on Parties, he points out, establishes that a party can be outlawed when it presents on its lists candidates convicted of terrorism and who have not publicly rejected their terrorist aims or means.
For this reason, it asks the Prosecutor’s Office to make the pertinent inquiries in this regard in the face of “the material impossibility of doing a job that corresponds to the Rule of Law, and not to the groups of victims of terrorism.”
It should be noted that in relation to another similar complaint from the JUCIL association, the State Attorney General’s Office has already rejected the banning of EH Bildu, considering that it is “a democratic political formation”.
“Contaminated lists since 2011”
To substantiate the extension of its complaint, Dignidad y Justicia provides “evidence documentation on the reiteration of the presentation of ‘contaminated lists’ since 2011”, the year in which ETA announced the cessation of its terrorist activity, “in the 2015 elections , 2016 and 2019”.
Specifically, it recalls that EH Bildu presented 9 candidates convicted of terrorism on its electoral lists in the 2015 municipal elections in Gipuzkoa.
In addition, it indicates that in the regional elections to the Basque Parliament in 2016, said party presented Iker Casanova Alonso as a candidate – and was elected -, sentenced in 2007 to 11 years in prison as the author of a crime of integration into a terrorist organization.
It adds that “at least” in the 2019 general and municipal elections, EH-Bildu presented 13 candidates convicted of terrorism on its electoral lists and provides the names of all of them.
Dignity and Justice denounced on Wednesday before the General Prosecutor’s Office the inclusion of 44 convicted of terrorism -7 of them for murder- in the Bildu lists seeking a new way to outlaw this formation after the National Court Prosecutor’s Office did not see crime in these facts by verifying that these candidates have already served their sentences without going into whether there were reasons for the illegalization of this formation.
The association argues that none of these 44 candidates convicted of terrorism have apologized for their crimes or collaborated with the Justice in resolving other crimes committed by the gang, which it understands would fit into the provisions of the aforementioned article of the Party Law. .
