The text will be debated this Tuesday in the Justice Commission – which will analyze the amendments presented by the groups – and voted on Wednesday in plenary, where, if there are no surprises, it will be definitively approved.
During its passage through Congress last week, the PSOE, with the support of the PP, introduced a modification to create an aggravated subtype within the crime of sexual assault so that the penalties are higher if there is violence and intimidation.
Confrontation with government partners
The reform of the law has highlighted the rupture of the government partners who, for the first time, voted separately for the correction of a regulation promoted by the Executive itself.
ERC and Bildu have presented amendments to the text, the same ones that they took to Congress and which were rejected. They request that articles 178 and 179 of the Criminal Code be maintained as they are in the law of the only yes is yes to “protect consent as the center of law.”
They argue that the reincorporation of the terms “violence and intimidation” as central to the criminal offense of sexual assault “displaces consent as the defining element between a consensual sexual relationship and sexual assault.”
Unidas Podemos does not have representation in the Senate, so it has not been able to present amendments, which, however, were along the same lines as those of ERC and EH-Bildu.
The PP, for its part, has renounced presenting amendments.
