Oviedo (EFE).- The investigating court number 2 of Oviedo has agreed to continue the proceedings of the open case against two local policemen who last June, when they were acting as civilians, fired several shots at a car that had been turned over. the escape after requesting documentation from the driver of the vehicle, who ran over them in their flight.
The court has adopted this decision against the criteria of the Prosecutor’s Office, which had requested the provisional filing of the case, the Public Ministry has reported.
The events occurred at 9:00 p.m. on June 24 when, according to the municipal version, two plainclothes agents on surveillance work against drug trafficking in the San Lázaro area approached a car parked on an esplanade with the identification plate hung from the chest and they requested the ID from the driver, a 20-year-old young man who was accompanied by his 19-year-old girlfriend.
At that moment, the vehicle started in reverse and its wheels passed over the foot of a police officer, and then it began moving forward, ramming the other officer, who had to throw himself and fired three shots at the wheels and the body of the vehicle, which was intercepted at about 800 meters.
For the Prosecutor’s Office, what happened was due to “a misunderstanding, together with an overreach of the agents in the exercise of their functions”, an action that should be examined in administrative and contentious-administrative proceedings.
For this reason, he had asked the court to file the procedure since they were authorized to patrol without uniform and that the area where the detainee and his girlfriend were located is a place specially monitored by the Local Police.
The Public Ministry argued that drug dealings and illegal vehicle races are frequent in that place, so the agents have an order to patrol the area and identify the people who were there in a suspicious attitude due to what their activity in that area, and the action against the young detainee and his girlfriend, would be framed within this preventive work.
However, the Investigating Court number 2 of Oviedo has determined to continue the proceedings for the procedures of the abbreviated procedure, in case the agents could be the perpetrators of a crime of attempted reckless homicide and a crime of injury, reported the Prosecutor of the Principality of Asturias.

Faced with this, at the request of the Public Prosecutor, the court has decreed the provisional archive of the case against the young man for possible crimes of assault and injuries, since he was not aware that the two agents were members of the Local Police by not wear a uniform, drive in a camouflaged car and not carry the license plate or show it in a regulated manner in an untravelled, dark and lonely area.
