Castelló (EFE) criminal responsibilities after having met with the Minister of Health, Miguel Mínguez, and having received a large part of the medical reports of the case.
The girl went to the emergency room up to three times, twice at the Viver health center and another at the Sagunto Hospital, but, according to her parents, “no tests were performed on her.”
Finally, on Sunday the 5th, the minor worsened, went into cardiorespiratory arrest and the SAMU doctors managed to stabilize her, took her to the Clinical Hospital of Valencia where she went into arrest again and finally died.
The lawyer explained to EFE that he met with the family last Friday and they gave him a report. The same day they already asked the manager of the Sagunto Hospital to deliver all the reports, which they were able to pick up at the Viver medical center’s emergency room.
EMPATHY OF THE HEALTH COUNCILOR
After having maintained contact with the Ministry of Health, Emma’s parents, Beatriz Gascón and Ramón Martínez, together with their lawyer, met today with the Minister of Health, Miguel Mínguez, a meeting in which they highlighted the “empathy” and good disposition of the minister, who has promised to get them all the necessary information.
Today they have also been able to collect other reports at the Hospital Clínico de València, where they have been received by the manager of this center.
They are still waiting to receive the SAMU report, which transcribes what happened between the moment the girl lost vital signs on Sunday, her resuscitation and her subsequent arrival at the Clinic, where she finally died, some reports that have also assured the family that will send them through a certified copy.
The legal representative of the family is now going to study all the documentation, he explained to EFE, and has indicated that he has received “absolute collaboration” from other professionals such as experts, to collaborate with the case.
CONTACTS WITH OTHER ORGANIZATIONS
It has also already maintained contacts with the Patient Defender association and its legal department, who have also urged the Prosecutor’s Office to investigate the case ex officio. The lawyer is also interested in meeting with the Valencia Prosecutor’s Office to “see if we can all go hand in hand.”
In the lawyer’s opinion, “it seems clear that possible criminal liability must be investigated” and for this reason he is already working on the complaint that he will present when he has all the documentation and information.
Predictably, the case will be assigned to the courts of Valencia, since the minor died in that city, despite the fact that the alleged negligence would not have been committed at the Hospital Clínico de València, but at Sagunto and at the Viver Health Center. .
For the moment, the autopsy carried out on Emma will be delivered to the Investigating Court number 10 of Valencia, which is the one that was on duty when she died.
The will of the lawyer is to clarify what happened and determine if any criminal responsibility can be inferred from the facts. To do this, he is studying all the documentation to argue the case and arrange against whom the complaint is directed, taking into account the possible negligence that could be committed in the health care of the minor.
