Seville (EFE).- The Early Care Law approved this Wednesday by the Andalusian Parliament puts an end to years of waiting in regulating care for children up to 6 years of age with a developmental disorder or at risk of having it. These are the twelve fundamental keys to the new text, which has been supported by all the groups except Vox, which has abstained.
1.- FOR THE FIRST TIME IT HAS THE RANK OF LAW
For the first time, the right to receive Early Care is regulated with the maximum possible normative range with which it can be guaranteed, since it is the first time that a law on this matter has been approved in the community.
2.- RIGHTS OF MINORS AND FAMILIES
The law includes the right of minors and their families to Early Attention and the use of services in equal conditions and without discrimination based on birth, sex, race, family situation, disability, ideology, belief, opinion or any other circumstance.
Assessment, monitoring and deadlines
3.- FIRST ASSESSMENT
The Pediatric Hospital Clinical Management Units, the Neonatology and Pediatric Primary Care Services for people under six years of age with developmental disorders or risk of presenting them will be in charge of making referrals to the Follow-up and Development Units.
4.- MONITORING AND DEVELOPMENT UNITS
They constitute the assistance device for coordinating and integrating the necessary resources that are part of the Comprehensive Early Care Network and will determine if the minor should be cared for in an Early Childhood Care Center (CAIT). These units will be under direct public management and will be integrated into the Primary Care level of the Andalusian Health Service.
5.- TERMS OF SERVICE
A period of 30 days is established for access to the CAIT and another three months for the provision of the treatment that has been considered necessary to begin. Access to the CAIT will take place once the minor’s need for treatment has been assessed by the Monitoring and Neurodevelopment Unit and a decision favorable to the intervention has been adopted.

6.- ASSIGNMENT OF A CAIT
As long as the availability of places allows it, the CAIT closest to the family home will be assigned preferably, without prejudice to the fact that, in certain developmental disorders, the preferential criterion for referral will be the specialization of the center, even if it is not the closest to the family home. The possibility of the existence of itinerant teams is contemplated.
7.- INDIVIDUALIZED PLAN
The basic team of the CAIT will initially carry out one or several reception interviews with the minor and their family, after which the Individualized Early Care Intervention Plan will be drawn up and a reference professional for the family will be designated. The possibility of including telematic and group sessions in this plan is contemplated if appropriate.
8.- COMMITMENT TO FAMILIES
The law states that the Board will make it easier for families to actively participate in the process of improvement, personal autonomy and social integration of which they are protagonists, as well as to comply with the rules, requirements and procedures for access to the different early care services. , facilitating the information and data that are required and that are necessary.
Information and sanctions
9.- INFORMATION SYSTEM
The Early Care Information System, developed by the Ministry of Health, will integrate into a single file all the information related to the management, interventions, and questions of any kind about the situation and evolutionary process of the minor person.
This information system must guarantee fluid access to information by the different professionals and families in order to improve the provision of the service.
10- PENALTY REGIME
For the first time, a sanctions regime is created for the first time to guarantee the best service and compliance by all with the approved norm, which contemplates infractions from minor to very serious with sanctions of 300 to 600,000 euros, which could also entail the suspension of the service and even the closure of a center.
11.- COORDINATION BETWEEN MINISTRIES
He points out as fundamental the specific coordination between the different areas with responsibility, so that, under the umbrella of the Ministry of Health, they work jointly with Educational Development and with Social Inclusion, Youth, Families and Equality, since the Integral Network of Early Care is made up of resources from the three departments.
Ownership of the Cait
12.- LOS CAIT
CAITs may be publicly or privately owned and be of a general or specific nature. The Department responsible for health may carry out the management of these resources under direct management or indirect management, either through contractual or non-contractual formulas, provided that they guarantee sufficient publicity and conform to the principles of transparency and non-discrimination.
It is regulated that the norm will have sufficient financing to provide this service, so that the money allocated to it will be established in the Budgets of the Junta de Andalucía on an annual basis. EFE
