Santiago de Compostela, Feb 8 (EFE) reported this Wednesday the Superior Court of Xustiza de Galicia (TSXG).
Pursuant to the new organic law for the comprehensive guarantee of sexual freedom, known as the law of only yes is yes, the magistrates have decided to reduce the sentence of a man who had abused his partner’s daughter, a minor, by 18 months. with a 33 percent disability.
The events occurred in 2017 at the defendant’s home, initially sentenced to 6 years in prison.
The magistrates of the Provincial Court also agreed to reduce the sentence of a man convicted of sexual assault on a 14-year-old girl, committed in September 2018, by 18 months.
The last of the sentence reviews was for two convicted, one for assault and rape and another for necessary cooperator of both crimes. The events occurred in 2016, and the first had his sentence reduced by one year under the new law.
The magistrates also agreed to reduce the sentence for the other convicted person by two years, from six years and six months to four years and six months.
In the records published by the sixth section, the members of the court also include two cases in which they refuse to review the sentences.
In the first of them they do it because “the new regulation is not more favourable, but, on the contrary, the conducts would be more seriously sanctioned”, and in the second because the rule of article 76.1 of the penal code is applied, setting “the maximum compliance limit in 20 years”, which the new law “does not modify”.
