The lawyer has opined, in statements to Rac1, that dejudicializing the Catalan conflict involves agreeing on an amnesty like the one approved in 1977 for the nearly “4,000 people” who, in his opinion, “have been legally affected” by the process, among which he has included himself.
After a general election that could give Junts a key role in the governance of Spain, Boye has insisted that neither Puigdemont nor former Minister Toni Comín have ever asked him “to find a personal solution for them”, but rather to defend them “as part of a judicially harassed political project”.
“But solving the political problem requires solving the judicial one, this should never have been prosecuted,” said the lawyer, who has stressed that an amnesty for those accused of the process would fit into the Spanish Constitution, which only prohibits general pardons.
It would be, he pointed out, an amnesty “specific for things and people who have been affected” by the causes of the process. “We are about 4,000,” she specified.
Likewise, Boye has denounced that the Prosecutor’s Office “decided to vote” when yesterday, one day after the 23J elections, it asked the Supreme Court to issue an international search and arrest warrant to arrest Puigdemont and Comín.
“Twenty days have passed since the sentence and they are making a move now. (The Prosecutor’s Office) follows in the wake of Vox, which requested it the day before the elections, ”he pointed out.
However, the lawyer has been convinced that “nothing will happen” if the Supreme Court judge Pablo Llarena reactivates the Euro-orders to arrest Puigdemont, in which case the former Catalan president will appear before the Belgian court and this, he has assured, “will issue his release without precautionary measures”.
“They will not preventively lock them up in jail, this is just a wet dream for some in Madrid,” Boye pointed out.
Puigdemont’s lawyer has also ruled out that the Belgian courts agree to the delivery of the former president of the Generalitat to Spain: “we will surely end up again in the Court of Justice of the European Union within a year or a year and a half”, he has predicted.
He has also stated that it is “a hoax” that Puigdemont and Comín are considering leaving for Switzerland to avoid being extradited to Spain.
