Toledo (EFE).- The popular jury unanimously declared the defendant guilty of killing his uncle during a fight on Christmas Eve 2020 in the Toledo municipality of El Viso de San Juan.
The nine members of the jury have considered proven all the points of the object of the verdict that has been delivered to them after finishing the hearing around 3:00 p.m., and in less than two hours they have issued the guilty verdict.
To this end, the spokesperson for the jury has indicated that they have taken into account the statements of the accused, the Civil Guard agents and the coroner who have passed through the Chamber on the first and only day of the trial, which has been substantiated in a only day, although it was planned for three.
Likewise, the jury has also considered proven the two mitigating measures proposed by the prosecutor, consisting of the fact that the defendant acted under the influence of drugs and alcohol, and the late confession.

In addition, the members of the jury have expressed that they are not satisfied with the granting of pardon or the suspension of the execution of the sentence for the defendant due to the seriousness of the facts.
With the reading of the verdict, the trial has been seen for sentencing and the request for a sentence by the Prosecutor’s Office has finally been six years in prison, so that it has taken into account the extenuating factors and has reduced the request to half now who initially requested 12 years.
When half of the sentence is served, the defendant, of Colombian origin, will be expelled from Spanish territory.
During the hearing, the defendant has acknowledged that he stuck a knife into his uncle, although he does not remember in which part of the body he was given the puncture and assures that he was not aware of the death until the following day.
He explained that at Christmas 2020 he lived in the town of El Viso de San Juan with his uncle and two other colleagues, that on Christmas Eve two couples were in the house in addition to himself and his uncle, who were drinking and consuming drugs all afternoon and into the early morning.
When they ran out of drugs and alcohol, he continued, his uncle became “more aggressive than normal” after being “heavy” at dinner and “rude” with the girls, and they decided to go to sleep.
The defendant says he gave him “a puncture”
The defendant has stated that he entered his room to get a mattress and there was his uncle with a knife, who stood in front of him and began to “challenge” him with the weapon until he went for him.
At that moment, he specified, he dodged the knife and pounced on him, to then hit him with “a few punches” and when he saw the knife on the ground, he picked it up and gave it “a prick.”
So, according to his statement, they both stood up, his uncle wanted to continue fighting and he left the house “to avoid further confrontations”, since he has pointed out that his uncle was an aggressive person who was even imprisoned in Colombia for murder. and convicted of mistreatment and violence with neighbors.
Given the recognition of the facts, the prosecutor and the defense have renounced several witnesses, although agents of the Judicial Police who intervened in the investigation and the coroner have appeared.
In the use of the last word, the defendant has said: “My intention was never to end the life of my uncle, I miss him and I am very sorry.” EFE
