According to the data collected by the Statistics Service of the General Council of the Judiciary (CGPJ), between January 1 and March 31 of this year, a total of 22,647 requests for marital dissolution have been presented in the judicial bodies and all the forms have decreased except for non-consensual separation demands, which have remained stable with respect to 2022.
The LAJ strike, which lasted from January 23 to March 28, has had an impact on the resolution of issues and also on entry, since the number of procedures distributed that have remained pending acceptance by the bodies judicial, and therefore they have not been computed as admitted, has grown “enormously” in the first quarter of 2023, explains the CGPJ.
Pending matters increase in the Courts for Violence against Women
In the case of civil matters of the Courts for Violence against Women, the cases pending to be accepted have gone from 20 in the first quarter of 2022 to 155 in the same period of 2023; in Family Courts, the increase has been from 177 to 4,077.
The 12,839 consensual divorce claims represent 12.8% less than those registered in the first quarter of 2022; the consensual separation demands, of which 550 have been filed, have decreased by 23.9%; the 8,954 not agreed are 5.7% less than those presented the previous year; while the claims for annulment have been 33.3% less (12).
The largest number of dissolutions, in the Canary Islands
The highest number of dissolution requests per 100,000 inhabitants has occurred in the Canary Islands, with 65.4; Navarra (56.4), Valencian Community (53.7); Andalusia (51.4); Balearic Islands (51) and Asturias (48.1).
In all these territories, the national average has been exceeded, which is 47.1 requests for marriage dissolution per 100,000 inhabitants. On the contrary, the lowest rates have been in La Rioja (30.7), Madrid (37.3) and Castilla y León, with 37.9.
Regarding the modification of measures in separation and divorce processes, all have decreased except for non-consensual non-marital child custody and maintenance demands, which have increased by 1.2% to 7,004.
The demands for modification of agreed measures (3,003) have decreased by 10.6%, while those not agreed (8,097) have done so by 4.9% compared to the same quarter of 2022, and the changes of guard measures, custody and maintenance of non-marital children agreed (5,382) decreased by 8.6%.
