The Official State Gazette (BOE) has published this Tuesday the decree of dissolution of the Cortes and call for elections, which will be, according to the law, 54 days later; therefore, on Sunday, July 23.
When the Cortes is dissolved, all the deputies and senators who are not part of the permanent councils cease to be parliamentarians, who lose their monthly salary.
That is why they are compensated with compensation, which is given in a single payment, which is taxed to the Treasury and which they receive only if they have no other income.
Allocations approved by the two parliamentary tables
These payments have to be approved by the two parliamentary tables, which in the last legislatures have been doing the calculation like this: prorate the constitutional allowance and the supplements that the parliamentarian received each month for the days remaining until the eve of the elections.
The basic monthly allowance received by a deputy is 3,126.89 euros and that of a senator is 3,173.83 euros, as currently set.
To these allocations is added a complement of expenses, called compensation in the regulations.
In Congress it is now 2,008.61 euros, except for the deputies elected by Madrid, which is 958.75 euros, while in the Senate it is 2,037.07 euros and 971.48 euros, respectively.
In addition, the members of the tables and the spokespersons of groups and commissions also charge other supplements, which are also included in the calculation.
In this way, a deputy or senator elected by Madrid can receive a transitional compensation of about 7,000 euros, but the forecast is that the majority of parliamentarians will be entitled to a salary close to 9,000 euros, a figure that is at their higher time for spokespersons and polling station members.
First the “finiquito” and then the “unemployment”
In addition, there is another compensation for dismissal, which is received by parliamentarians when they leave, and which may be requested by those who do not appear on electoral lists and those who are not elected.
If the transition compensation is a kind of “settlement”, the termination compensation would be like a monthly “unemployment” benefit.
Both are only charged if you have no other income; for example, by appointment to another public office.
The severance pay is based on the years in which you have been a parliamentarian, with a minimum of two, and would mean a monthly payment for each year in office, with a maximum of twenty-four monthly payments.
The members of the permanent councils, which are the bodies in charge of each chamber in charge of continuing parliamentary activity, including the legislative one, although conditionally, do not receive the transitional compensation.
Those 68 deputies and 37 senators continue with their constitutional assignment, since they maintain the full condition of parliamentarians until the new chambers are constituted.
The constitution of the Congress and the Senate for the XV Legislature has been set for August 17, at 10 am.
