Oviedo, Apr 10 (EFE).- The seven-year-old girl who fell from the fifth floor in the arms of her mother last Wednesday remains stable and out of danger at the Central Hospital of Asturias (HUCA), in Oviedo, according to the father’s lawyer, who hopes that the case opened against the parent will be classified as an attempted murder with the aggravating factor of kinship.
This is one of the four cases that his client has open with his daughter’s maternal family, after those that were filed in 2017 and 2018 for mistreatment between the two were closed, said his lawyer, Sofía Duart Álvarez de Cienfuegos. , in statements to EFE.
However, it will not be known if she is accused of a crime of attempted homicide or murder until the investigation opened by the Court of First Instance and Instruction number 5 of Avilés is concluded as a result of the mother throwing herself with her daughter. in her arms from a window of her house, located on the fifth floor of Avenida de los Telares in this town.
Despite the girl’s screams for her not to throw her out of the window, mother and daughter plunged and fell onto a parked car, which broke their fall, before sprawling on the pavement.
After the event, the head of the duty court agreed to withdraw custody and parental authority of her daughter from the mother, issued a restraining order and did not recognize any visitation regime, the father’s lawyer recalled today, who will take to live the girl with him as soon as he leaves the hospital.
In principle, the lawyer does not anticipate that her client will testify this week for the open case against the mother, who is still admitted to the HUCA, although it is likely that she will do so for another open case for an alleged crime of threats by the grandfather. maternal.
The latter remains in provisional detention at the Asturias Penitentiary Center as the alleged perpetrator of a crime of attempted homicide and breach of a restraining order from the girl’s father, who on the day of the events waited in a doorway with a knife, hammer and pepper spray
In his statement before the judge, the grandfather acknowledged the facts and justified them in the tension and nerves that the fact that his granddaughter’s father had recovered the visiting regime had caused the entire family, according to his lawyer’s account, Maria Luisa Nevado.
In addition to the two cases mentioned, the grandfather has a third one open for a few months for another attempted assault with a knife that also led to a restraining order, according to Duart, who was currently preparing a lawsuit to request custody of the girl. for the father, but which he did not have time to present.
Since they stopped living together shortly after the girl was born in 2016, there have been complaints between the parents -they never got married- and both have been convicted of ill-treatment.
According to the lawyer, another complaint also ended in dismissal that, as a result of the father requesting joint custody, the mother filed for sexual abuse of the girl, when she was four years old, which led to supervised visits for the father for three years.
