These doctors have testified on the third day of the trial with a popular court that is being held in the Provincial Court of Logroño against Francisco Javier Almeida, considered the alleged perpetrator of the murder and sexual assault of the minor on October 28, 2021, while he was on probation .
The two forensic experts from the Institute of Legal Medicine of La Rioja, who also took biological samples from the body before it was removed, have explained that the child had no erosive injuries on his body that would suggest that there was some kind of fight or defense against his attacker.
Based on the injuries to the child’s neck, they concluded that death was caused by “compression”, which caused a hemorrhage in his left ear; and they also found blood in both nostrils.
They have insisted that the pressure exerted on the neck was very strong because the bleeding was very intense, much more than the injuries produced after hanging, a cause of death in which they have said they have experience in autopsies.
All the bruises that Álex had on his face, neck and chest occurred in life, many of them due to restraint or immobilization, as they have interpreted in their report.
INTENSE AND PROLONGED COMPRESSION
They have also indicated that the aggressor pressed with great force and for a long time, with his forearm on the child’s neck, with very intense compression, which usually causes him to lose consciousness within a period of between 5 and 8 seconds.
However, they have qualified that this loss of consciousness was not rapid because there are injuries caused by the erosion of the child’s clothing on his skin, caused by the movement of the child when trying to escape.
“The attacker did not use enough force at first to cause his death,” one of the forensic experts concluded after analyzing the injuries, both internal and external.
In this sense, the defense lawyer has asked her if these marks “could be compatible with covering the child’s mouth to prevent him from screaming, not to kill him”, but one of the doctors has pointed out that she cannot assess the intentionality of the acts .
In addition, they have detailed that they found restraint marks on a firm surface, such as the floor or a wall, on the child’s body; and on his hand there was an ecchymosis or small finger-like bruise, which led them to think that his assailant immobilized him.
In this trial, the prosecutor and the private accusations, by Álex’s family, and the popular one, represented by the Clara Campoamor Association, demand permanent reviewable prison for Almeida for the crime of murder and 15 years in prison for sexual assault. His defense calls for acquittal.
