In the plenary session, the partial amendments incorporated in the Senate to said initiative for the protection of domestic and wild animals in captivity will be voted on, which is being processed in parallel to the bill to reform the Penal Code on animal abuse, also pending approval. ratified by the plenary session of Congress.
The plenary will decide on almost twenty amendments presented in the last process in the Senate to the first of these bills, by the socialist group and also by Más Madrid, Compromis, Junts per Catalunya, ERC-EH Bildu and PNV.
Those that obtain the simple majority of the Chamber will be incorporated into the final text of the law that would be ready for publication in the BOE and its entry into force, after six months.
On the other hand, in relation to the other bill, for the reform of the Criminal Code on animal abuse, a dozen amendments have been presented by the same groups, except the PSOE, which will also be seen and voted on tomorrow in plenary session of the Senate.
In this case and given its organic nature, the initiative requires the support of the absolute majority of the Chamber, 176 votes, in a final joint vote. In case of reaching it, it would conclude its parliamentary process and it would be ready for its publication in the BOE and its entry into force.
The amendments incorporated in the Senate to said bill to reform the Criminal Code are all aimed at modifying aspects of the text to prevent animals victims of abuse from returning to the hands of those who inflicted damage on them once they have served their sentences. .
As for the amendments approved in the last stage of the Senate to the other bill, the one on animal welfare, there are several from the socialist group, the majority of wording and technical improvements.
One of them, aimed at those who have a species at home that meets dangerous or precautionary criteria for the conservation of threatened wildlife, obliges them to inform the authorities within a maximum period of six months from the entry into force of this law. .
In addition, until the approval of the positive list of permitted species, the competent authorities must adopt the necessary measures for the intervention and availability of the specimens in centers for the protection of wild animals, zoos or animal protection entities, according to the text of the same.
On the other hand, Más Madrid and Junts per Çatalunya, in their amendments incorporated in the Senate, urge to modify the text of the bill to prevent homeless people from being subject to discretionary sanctions for living with animals on the street.
“Consequently, the prohibition of begging using pets or wild animals in captivity is deleted and a subsection is added that expressly exempts the right of homeless people to be accompanied by their pets.”
The Catalan formation also proposes improvements in the face of invasions of jurisdiction and that the article of the norm in which it speaks of “feral cats” be modified, because these will cease to be so with the control measures established for feline colonies and to avoid regulatory contradictions .
EH Bildu proposes to change the eighth final provision because it considers it unrealistic to say that the measures of this law will not imply public spending or added endowments, since more personnel and material resources will be required to comply with it.
The PNV proposes in its amendments several modifications due to “invasion of jurisdiction” and the deletion of two sections of article 23 on obligations of public animal protection centers as they are considered very demanding and “onerous for municipalities.”
This controversial regulation from the beginning of its processing, has been promoted by the Minister of Social Rights, Ione Belarra, of Podemos, who has said of it that it is a “pioneer” and marks the beginning of a new path to end “impunity of abusers” in this country.
The bill leaves hunting, herding, sports or police dogs, among others, out of the text; includes a positive list of pets allowed in homes, toughens penalties up to 200,000 euros depending on the seriousness of the offense and prohibits the sale and exhibition of dogs in pet stores, among other novelties.
