Santa Cruz de Tenerife (EFE).- The former mayor of La Laguna José Alberto Díaz (CC) has demanded the resignation of councilor Santiago Pérez, complainant of the “Reparos” case that has been filed by the Supreme Court, and the PSOE to proceed to his dismissal as a senator, for having “fraudulently” used the law for his political benefit.
In statements to EFE, José Alberto Díaz, who was mayor between 2015 and 2019, has indicated that he will present a brief to the Investigating Court number 4 of La Laguna, which is instructing the case, to request that it be archived following the criteria set by the Court Supreme when closing the part related to Fernando Clavijo for not appreciating a crime.
The complaint that gave rise to the proceedings was presented by the councilor and socialist senator Santiago Pérez for alleged administrative prevarication by the then mayor Fernando Clavijo when, between 2011 and 2014, he issued more than a hundred decrees lifting the objections of the General Intervention against the extensions and continuity of public service contracts.
José Alberto Díaz recalled that this complaint was extensive to nationalist councillors, officials of the Consistory and himself in his time as mayor of La Laguna, in the term following Clavijo’s.
Díaz, who has recalled that another complaint in which Santiago Pérez participated, the so-called Crane case, has also been archived, has indicated that this action affected the entire electoral process of the 2019 elections and now its archive by the Supreme Court corroborates “what we had been denouncing, that there was a clear and evident political use to cause damage” before the elections.
“What now corresponds to the complainant and his political organization is to act accordingly and for ethics, his resignation corresponds, and the PSOE to dismiss him as a senator because, if the party affirms that it acts as soon as an irregularity is committed, it must designate another senator who represent the interests of the Canary Islands”, he stressed.
Asked if Santiago Pérez has contacted him to apologize, José Alberto Díaz has said that “not at all” and has added that the current mayor of Urbanismo de La Laguna “repeatedly tells lies, such as when he said that he was not a complainant in the Grúas case and then stated that this case, compared to the Reparos, was child’s play”.
Now “his position of never acknowledging falsehood and violation of democracy” and the principle of presumption of innocence is evident, which generates discomfort unbecoming of a democratic society “and he has to answer for that action”, the former mayor has reiterated .
In his opinion, Pérez’s action represents a break in the relationship of a public office with the citizens because “he does not stop accusing, sentencing and does not respect judicial processes, because I have heard him complain about judges, their resolutions and the Supreme Court, that they don’t listen to you.”
In his opinion, Santiago Pérez has “a sick obsession” to be permanently like the one who establishes jurisprudence despite the fact that later the Judiciary does not stop stating that, in his successive complaints, “there has been nothing.”
In this case, the order of the Supreme Court “is forceful, it is full of content and it is explanatory” in that raising objections is not an illegal situation, despite the fact that “this man” has cast doubt on society about an action irregular.
“The consequence should be that he responds democratically and resigns as a councilor because he is not a trustworthy man. If everything he has said is a lie, how do we know that it is true when he talks about the issues in which he has responsibility? ”, The former mayor appreciated, to recall that on one occasion Santiago Pérez called him a “mafioso”.
It has been 10 years of “legal use” of municipal issues despite the fact that in his performance as mayor of La Laguna he has had “a clear conscience”, but he also acknowledges that the situation created as a result of the complaints has affected his spirit, to their daily chores and their family environment.
