Valladolid (EFE).- The Criminal Court number 1 of Soria has sentenced to one year in prison the man who slapped his wife while she was doing a live on the social network TikTok when she was talking with three other young people on January 28 , a video that ended up going viral, and has also imposed a ban on coming within 300 meters of her for three years.
The judge, according to the sentence to which the EFE Agency has had access, considers the man the author of a crime of ill-treatment in the field of violence against women and prevents him from communicating with her by any means or procedure, direct or indirect. for another three years, the same time that the right to possess and carry weapons will be deprived.
During the trial, both the man and the victim accepted their right not to testify, although the woman, who was very nervous, only intervened to insist that her husband had never mistreated her, nor did he force her to say so. In fact, the woman did not file a complaint.
With this ruling, the judge agrees to the request of the prosecutor who, during the trial, indicated that there are two interventions by the Police that reflect a conflictive situation in the couple and that, in addition, they confirm the “power relationship” that the man on the victim.
The prosecutor also recalled that in a later video on that same social network, the woman admitted that her husband had beaten her twice.
For her part, the judge considers in the sentence that the man, “in a public and notorious manner, in front of thousands of people, assaulted his wife with the intention of undermining her physical integrity and humiliating her in public, without any record that he caused her injuries, although there was obvious and real mistreatment.”
The magistrate clarifies that in crimes of gender violence the victim’s complaint is not necessary, and punishment must be given once the commission is known.
“The simple fact of the live broadcast of the slap is enough for the public powers to deploy the scope of protection of the victim, regardless of whether she recognizes herself as such,” he recalled.
In the same way, it has indicated that “it is not a justification of the aggression, nor does it mean that it is not punished, the fact that the victim consents and justifies the slap.”
And it adds that in crimes of violence against women, as in all crimes of serious injuries, the consent of the person attacked is irrelevant and punishment is appropriate in all cases.
The judge also insists that with this attack the man imposed his domination over his wife on social networks, without the fact that he was live making him stop his attack.
“This conduct deserves the greatest criminal reproach that the law allows, it deserves the maximum penalty to be imposed, since the defendant is not capable of respecting his wife, not even in public,” reprimands the judge, who adds: “Apparently, this behavior has already been repeated on previous occasions since the victim acknowledges that, prior to these events, he has received two beatings,” he concluded.
In the video that led to the opening of these legal proceedings, it was possible to see how this woman received a strong slap in the face while she was chatting live with three young boys.
At the time of the attack, the victim stated that her father had hit her, although in a later direct she explained that it was her partner who had slapped her.
Given the repercussions of these images, the man appeared at the offices of the Soria Provincial Police Station to communicate that, as a result of that video and because of the scope it was having, they were receiving many threats and insults.
However, after the inquiries of the agents, the Police decided to proceed with his arrest as the alleged perpetrator of the attack.
