As detailed in the resolution, although the total amount of paid salary concepts exceeds what would correspond to the proportional part of the annual SMI, it has been verified that, in most cases of workers who begin their services on 1 November 2021 and December 1, 2021, the remuneration received at the end of the first month is “significantly lower” than the SMI.
The company postpones compliance with the obligation to pay part of the salary (the one linked to what it calls variables) for a month, paying only the fixed part established in the contract, to then proceed, at the end of the following month, to the payment of the differences based on the hours of flights carried out, the document continues.
As they are full-time contracted workers, regardless of whether part of their remuneration is directly linked to the hours of flight actually performed, the company has the obligation to guarantee the receipt, on a monthly basis, of at least the amount established as salary. interprofessional minimum, indicates the resolution.
The Labor Inspectorate explains that, otherwise, without the monthly payment of at least that amount, “it would not be possible to achieve the objective that the minimum wage regulations pursue, which is none other than to make effective the right to an equitable and sufficient remuneration that provides workers and their families with a decent standard of living”.
