Mahón (EFE).- The head of the Investigating Court number 1 of Ciutadella (Menorca), Juan Pablo Molina, along with two forensic experts and the lawyers for the parties, supervised this Friday the exhumation of the remains of the alleged grandparents of a woman who claims to be recognized as the daughter of a millionaire whose body was cremated.
The plaintiff is a 77-year-old woman residing in Malaga and claims the legitimate part of an inheritance of around 40 million euros shared by the nephews of José María de Olivar Despujol, a Menorcan nobleman who died without recognized issue, for which reason her Fortune remained for his nephews.
As explained by the lawyer defending the plaintiff, Fernando Osuna, the woman was born as a result of a dating relationship between her mother and the magnate, who did not accept the pregnancy.
Unable to analyze the alleged father’s DNA because the body was cremated at death, the possible uncles were asked to submit to the tests, but they also refused.
“We don’t like to exhume corpses, but when there is no other choice, there is no other way, despite being drastic and uncomfortable. The other party has refused to collaborate at all times, ”the lawyer told EFE, who has been confident in demonstrating the family relationship between the plaintiff and her alleged parent indirectly from the remains of the alleged grandparents of her
“If the DNA test is affirmative, 99% paternity would be proven, although there are also witnesses, documents and other obviousness. This test prevails over the rest ”, he assured.
The other evidence that “corroborates the relationship” with the millionaire from Menorca
The plaintiff’s lawyer has recalled that among the evidence put forward is the great physical resemblance to the alleged father, the letters that he and the mother exchanged, the bank deposits made by him, as well as the fact that he carried the first surname of his hypothetical parent in the school notes “that corroborate the relationship”.
Once the DNA samples have been extracted from the bodies, they will be sent to the National Institute of Toxicology.
“We believe that in one or two months we will have the result and the judge will set the date for the oral hearing. We hope it will be soon because we have been in this process for three years”, the lawyer specified.
In the case of demonstrating the family link, the plaintiff would be entitled to a quarter of the inheritance, which is estimated at around 40 million euros. Among the assets are palaces, houses, bank accounts, works of art and rustic land.
