This is established by a new instruction from the Ministry of the Interior, 1/2023, which will enter into force this Friday, the 10th, and which the Secretary of State for Security, Rafael Pérez, signed this Thursday, in line with the criteria set by the Attorney General’s Office. and the State Advocacy that ponder the balance between the right to data protection and the risk for a victim.
There are currently 7,771 cases registered in the VioGén system of special relevance (6,833 at medium risk, 920 at high risk and 18 at extreme risk), while 61,079 aggressors have two or more complaints from different women, that is, they are persistent aggressors and therefore more prone to attack more harmfully, as to break legal measures.
Interior sources explain that this order will not imply an automated notice, but rather a complaint from the victim or those around him and a police assessment that shows a medium risk level of special relevance, high or extreme.
Agents will take into account only existing VioGén records from the last five years and, when a new VioGén registration involving a repeat offender occurs, the cases of previous victims that are active will be re-evaluated immediately.
