Madrid (EFE).- The State Attorney General’s Office has established some guidelines on the penal reform that lowers some embezzlement penalties, such as when personal profit is not received, and has clarified that this profit motive will be appreciated as long as there is a willingness to dispose of of public money to “achieve an advantage or own benefit”, without the need for there to be a “patrimonial advantage or an economic increase”.
The State Attorney General, Álvaro García Ortiz, has issued a mandatory decree on Wednesday for all prosecutors to try to establish guidelines and unify criteria in order to achieve a uniform response after the reform of the Penal Code promoted by the Government.
The Prosecutor’s Office assures that “no embezzlement conduct” will go unpunished and establishes that prosecutors will not support reviewing those convictions “for crimes of appropriative embezzlement”, given that the new law has established identical penalties as the previous Penal Code.
